[1] The applicant seek leave to appeal against the judgment and order s handed down
on 14 July 2026.
[2] Section 17(1)(a) of the Superior Courts Act 10 of 2013 permits leave to appeal only
where the Court is of the opinion that the appeal would have a reasonable

prospect of success, or where some other compelling reason exists why the
appeal should be heard.
[3] I have considered the grounds of appeal and the submissions advanced on behalf
of the parties. Having reconsidered the judgment in light of all the grounds
advanced, I am not of the opinion that an appeal would have a reasonable
prospect of success. Nor has any other compelling reason been established why
an appeal should be heard.
[4] Since the respondent is represented on a pro bono basis, no costs order is granted
in her favour.
ORDER
In the result, the following order is granted:
1. The application for leave to appeal is dismissed.
2. No order as to costs.
