VARIATION OF AN ORDER OR JUDGMENT
TEFFO, J:
[1] On 10 April 2026 I handed down judgment in the above matter wherein
the following order was made:
“[81] In the result I make the following order:
1. The plaintiffs’ claim against the defendant is dismissed.
2. The plaintiffs are to pay the costs of this action jointly and severally,
the one paying the other to be absolved.”
[2] Paragraphs 79 and 80 of judgment read as follows:
“[79] Counsel for the defendant sought costs of three counsel and the
qualifying fees of the expert witnesses called by the defendant to testify.
[80] The complexity and volume of this matter justify costs of three
counsel on Scale B and the qualifying fees of the expert witnesses called
by the defendant.”
[3] The above order does not reflect the costs order as set out in the
judgment. The omission of the costs order was made in error. Furthermore,
the defendant sought costs on Scale C and not on Scale B as reflected in
paragraph 80 of the judgment. The reference to Scale B in the judgment was
made in error.

[4] In terms of Uniform Rule 42( 1 )(b) the following corrections are made:
4.1 Paragraph 81.2 of the judgment is amended to include the costs
of three counsel and the scale as follows:
"The plaintiffs are to pay the costs of this action jointly and
severally, the one paying the other to be absolved. These
costs include the costs of three counsel on Scale C and
the qualifying fees of the expert witnesses called by the
defendant."
4.2 Paragraph 80 of the judgment is amended as follows:
"[BO] The complexity and volume of this matter justify costs
of three counsel on Scale C and the qualifying fees of the
expert witnesses called by the defendant."
