The applicant, Mr
Ngqeleni, has launched motion proceedings against the respondent
retail company, Shoprite.
2.
Mr Ngqeleni claims a
declaration that a franchise agreement is unlawful and he seeks
payment of R7.8m. The legal bases for the claims
are not clear and
there appears to be no quantification of the R7.8m.
3.
The answering affidavit
raises huge disputes of fact.
4.
It would be unwise to
attempt to decide this case on paper.
ORDER
1.
The notice of motion
stands as a simple summons.
2.
The notice of intention
to oppose stands as a notice to defend.
3.
The applicant is to
deliver a declaration by 30 June 2026.

Thereafter, the matter
proceeds as a trial action.
