[1] The matter was referred to the High Court on special review in terms of the Child Justice
Act 75 of 2008 as amended. In considering whether the proceedings were in
accordance with justice regard was had to the matter of Connolly v Ferguson 1909 TS
195n, where Innes CJ at 198 noted the following;
