[1] This is an application for leave to appeal brought by the Applicant against the
judgment and order of this Court issued on 8 July 2025 in terms of which:

1. The late filing of the Applicant’s review application is condoned.
2. The Second Respondent’s award under case number LP4966/18
dated 24 September 2018 is reviewed and set aside and substituted
with the order that the dismissal of the Third Respondent by the
Applicant was substantively fair.
3. There is no order as to costs.
[2] On 28 July 2025, the Applicant filed an application for leave to appeal.
[3] On 15 August 2025, the Respondent filed written submissions in terms of
Rule 67(5) opposing the Applicant’s application for leave to appeal.
[4] On 29 August 2025, the Applicant filed a further opposing submissions.
[5] I have considered the grounds upon which leave to appeal is sought and all
the submissions filed in the matter and reflected on the judgment. I am not
persuaded that the appeal has reasonable prospects of success or that
another court would come to a different conclusion. All of the issues set out in
the application for leave to appeal and the opposing submissions were
considered during the hearing. The application stands to be dismissed.
[6] In the premises, the following order is made:
