JUDGMENT
– LEAVE TO APPEAL
RABKIN-NAICKER,
J:
[1]
I have read the application for condonation for the late filing of
the written submissions and the submissions of both parties
in
respect of the application for leave to appeal.
[2]
Given that the applicant’s written submission were filed one
(1) day late, I am inclined to grant the application for
condonation.
[3]
In as far as the application for leave to appeal is concerned, I do
not consider that there are any prospects of success on
appeal.
[4]
In the premises, the following order is made:
1.
The application for condonation for the late filing of the written
submissions is granted
with no order as to costs.
2.
The application for leave to appeal is dismissed with costs,
including the costs of one (1)
counsel.
