This is an application for leave to appeal against the judgment
handed down by this court on 28 May 2013.

The applicant filed its notice for application for leave to appeal
timeously on 13 June 2013 and thereafter filed its submissions
on 25
April 2013. The third respondent filed its opposing submissions
thereafter.

It is unfortunate that this application only came to my attention on
24 April 2014.

Having considered the grounds on which the applicant seeks to appeal
the judgment as well as the third respondent’s response

thereto, I am satisfied that there are reasonable prospects that a
different court could come to a different conclusion in this
matter.

I therefore, make the following order:
a.
The applicant’s application for leave
to appeal is granted
b.
There is no order as to costs.
