JUDGMENT: APPLICATION
LEAVE TO APPEAL
GUSH, J
:
The second applicant in
this matter has filed a notice of application for leave to appeal
against the ex tempore judgement which
was handed down on
15
February 2013
in which judgment I dismissed the applicant’s
application with costs.
In response to the
second applicant's application for leave to appeal the third
respondent simply filed a notice "Opposing
of Leave to Appeal"
(sic).
The applicant has set
out in its application for leave the grounds upon which it relies
and upon which the application for leave
to appeal is based.
I have carefully
considered the second applicant’s application for leave to
appeal and despite the absence of any submissions
by the third
respondent, I am not persuaded that there is a reasonable
possibility that another court would come to a different
decision.
In the circumstances the

applicant’s application for leave to appeal is
dismissed with no order as to costs
