RULING
– APPLICATION FOR LEAVE TO APPEAL
MOSHOANA,
J
[1]
This
is an application for leave to appeal against the judgment and order
of this Court handed down on 23 May 2023.
[2]
The
application for leave to appeal was launched woefully late. The
explanation for the late delivery is not a reasonable one. The
applicant lacks
reasonable
prospects of success. Accordingly, condonation for the late delivery
falls to be dismissed. Since condonation is refused,
this Court lacks
the necessary jurisdiction to entertain the present application.
Order
1.
The
application for condonation for the late filing of the application
for leave to appeal is dismissed.
2.
The
application for leave to appeal is dismissed for want of
jurisdiction.
3.
There
is no order as to costs.
G.
N. Moshoana
Judge
of the Labour Court of South Africa
