ORDER
After
having heard counsel on behalf of the parties and having read the
papers filed of record, it is ordered
pendente lite
as
follows:
1. The respondent shall
pay to the applicant the sum of R50 000.00 (fifty thousand Rand) per
month as maintenance
pendente lite
which amount shall be
payable before the 1st of December 2016 and monthly thereafter on or
before the first day of each month directly
into the bank account
nominated by the applicant's attorney of record for that purpose;
2. The amount of R50
000.00 ( fifty thousand Rand) in respect of maintenance and referred
to in paragraph 1 above, shall be paid
to the applicant in addition
to her present salary paid by the respondent and/or the Farm-Inn
Hotel in the sum of R25 843.44 and,
should the applicant's salary in
the aforesaid sum for any reason whatsoever be reduced below the said
sum, the sum of R50 000.00
( fifty thousand Rand) payable in respect
of maintenance as stated in paragraph 1, will be increased with an
amount equal to the
amount with which the applicant's monthly salary
paid by the respondent or the Farm-Inn Hotel is reduced;
3. The respondent shall
make payment of the applicant's medical expenses inclusive of
doctors, dentist, optometrist, pharmaceutical,
orthodontic and
ophthalmic expenses that are reasonably necessary and incurred by the
applicant and the respondent shall keep the
applicant registered as a
beneficiary and/or dependent of his medical aid scheme and pay all
monthly contributions in respect of
the applicant's membership to the
medical scheme;
4. The respondent shall
make payment to the applicant of the monthly instalments in relation
to the applicant's motor vehicle, a
Toyota Double Cab bakkie with
registration number F[...]GP into the applicant's Nedbank current
account, account No [...] on or
before 1 December 2016 and thereafter
on or before the first day of each succeeding month in the sum of R9
005.42 (nine thousand
and five Rand and forty two cents);
5. The respondent shall
make payment of all costs pertaining to the upkeep of the applicant's
horses including, but not limited
to their feed, farrier charges,
veterinary expenses within 7 days of being requested to do so in
writing by the applicant or her
attorney;
6. The respondent shall
pay to the applicant the sum of R150 000.00 (one hundred and fifty
thousand Rand) as a contribution towards
the applicant's legal costs
which amount shall be payable before or on 15 December 2016;
7. The respondent is
ordered to pay the costs of this application in terms of Rule 43 and
it is ordered that the fee limitations
imposed in terms of Rule 43(7)
and (8) shall not apply to the taxation of the costs payable in terms
of this order.
