1. The parties are in agreement that
the Rule 43 Application is confidential. They do not want a
journalist, Ms P Joubert to be
present in court, to be able to read
the papers or to report on the matter in a way which identifies the
parties.
2. The two children referred to in the
Rule 43 Application are 21 and 23 years of age.
3. In my view the rights of the press
and the public are sufficiently important that I make the following
order.
Order:
1. Ms Joubert, any other journalist and
members of the public may remain in court while the Rule 43
Application is being argued.
2. Any person may read the documents
filed in the Rule 43 Application being heard by Wright J.
3. All persons are entitled to a copy
of this judgment and the judgment in the Rule 43 Application.
4. The press may report on this
application by the press and on the Rule 43 Application.
5. No person may report on either this
application or on the Rule 43 Application in any way that allows a
reader to identify or
be able to identify either the parties or
either of their children.
