In the matter between
TSHENOLO MAGRIET
KWADI
Applicant
and
MINISTER OF HOME
AFFAIRS
Respondent
JUDGMENT
EX TEMPORE
WILSON,
J
:
In
this matter, the applicant seeks the correction of the population
register to ensure that her identity number no longer reflects
her as
married to her deceased husband.
The applicant has
unfortunately been dealing with an incorrect entry on the population
register for some years. Given that
the problem is
long-standing, is not clear to me why this matter has been brought to
the urgent court.
There appears to be
a court order directing the correction that has not been complied
with, but no reason has been advanced why
an application compelling
compliance with that order or declaring the respondents to be in
contempt of it is so urgent that it
may not be heard in the ordinary
course.
When this matter
was first enrolled on 4 June 2026, I issued my roll with a set of
directives, which required the applicant to make
the matter
accessible to me on CaseLines or to show cause today why the
application should not be struck from the roll. The
matter was
not made available to me on CaseLines, and is still not accessible to
me. Counsel’s submissions as to urgency
also demonstrate that
the matter is manifestly not urgent for the reasons that I have
given.
For all those
reasons, the application is struck from the roll.
WILSON, J
JUDGE OF THE HIGH COURT
